Terms of Service

1. Agreeing to these terms

These terms are an agreement between you and VibeTemp LLC, a Colorado company (“we” and “us”), about the Cetchup apps and cetchup.ai (together, “Cetchup”). By creating an account or using Cetchup, you agree to these terms and to our Privacy Policy. If you don't agree, don't use Cetchup.

2. Who can use Cetchup

• You must be 18 or older.
• You sign in with your email address and a one-time code. Keep your email account secure, because anyone who can read it can sign in as you.
• You're responsible for what happens on your account. Tell us at support@cetchup.ai if you think someone else is using it.

3. Acceptable use

Don't use Cetchup to:

• harass, threaten, bully or abuse anyone, or post hateful content;
• share anything illegal, including any content that sexualizes minors;
• share someone's private information, or private photos of them, without their permission;
• send spam, scams or malware, or pretend to be someone else;
• get into accounts or chats that aren't yours, guess invite codes, or get around Cetchup's limits, plans or security;
• overload, disrupt or interfere with Cetchup or the services it relies on.

You can block people and report messages or people in the app. We review reports, and we may remove content or accounts that break these terms.

4. Your content

The messages, photos and other things you send in Cetchup are yours. You keep all your rights to them.

You give us permission to host, store, copy, process, send and display your content only as needed to run Cetchup for you and the people you chat with. That includes sending it to Muse Spark when you, or another member of a chat you're in, asks for a catch-up or an answer. This permission ends when your content is deleted, except for copies described in the Privacy Policy, such as reports.

You're responsible for what you send, and you confirm you have the right to share it.

5. AI output can be wrong

Catch-ups and answers are written by Muse Spark, Meta's AI model. They can be wrong, incomplete or out of date, even though every item points to the messages it came from. Check those messages before you rely on a catch-up, and don't use Cetchup to make important decisions about health, money, legal matters or safety.

6. Instagram, Snapchat and other services

Cetchup works with services run by other companies: Muse Spark by Meta, purchases and TestFlight by Apple, and, if you use them, Instagram and Snapchat.

• When you use the Instagram or Snapchat features, you use those services under their own terms, and you're responsible for following them. Cetchup reads a chat there only when you tap, from the chat you have open.
• Those features depend on how Instagram and Snapchat work, so they may change or stop working at any time.
• Cetchup isn't affiliated with, endorsed by or sponsored by Meta, Instagram or Snap. Instagram is a trademark of Meta, and Snapchat is a trademark of Snap Inc.

We aren't responsible for those services or their content.

7. Plans and payments

• Plans. Each plan is a number of messages Muse Spark reads for you a day: Free 150, Plus 400 and Pro 1,000. Pro also reads catch-ups aloud. The count resets at midnight Mountain Time.
• Apple subscriptions. Plus and Pro are monthly subscriptions sold through Apple's App Store and charged to your Apple account. They renew automatically unless you turn off auto-renew at least 24 hours before the current period ends.
• Managing and cancelling. Manage or cancel in your Apple account settings. On iPhone: the Settings app, your name, then Subscriptions. After you cancel, your plan lasts until the end of the period you've paid for. Deleting the app or your Cetchup account doesn't cancel the subscription.
• Refunds. Apple handles all payments and refunds. We can't issue refunds ourselves. You can ask Apple for one at reportaproblem.apple.com.
• Testing. Purchases made in a TestFlight build use Apple's test environment and aren't charged.
• Changes. We may change plans, allowances or prices. A price change to your subscription follows Apple's rules, which include telling you first.

8. Suspension and termination

You can stop using Cetchup and delete your account at any time. We may suspend or close your account if you break these terms, if the law requires it, or to protect people or Cetchup. We may also change Cetchup, or stop offering it or any part of it. If we shut Cetchup down, we'll try to tell you first.

9. Disclaimers

Cetchup is provided “as is” and “as available.” To the fullest extent the law allows, we make no promises or warranties about it, express or implied, including that it will always be available, free of errors, or accurate. Some places don't allow these disclaimers, so parts of this section may not apply to you.

10. Limitation of liability

To the fullest extent the law allows, VibeTemp LLC isn't liable for indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill, that come from your use of Cetchup. Our total liability for any claim about Cetchup is limited to the amount you paid for Cetchup in the 12 months before the claim. Some places don't allow these limits, so they may not apply to you.

11. Indemnity

If someone makes a claim against us because of what you sent in Cetchup, or because you broke these terms or the law, you agree to cover our reasonable costs from that claim, including reasonable legal fees.

12. Governing law

These terms are governed by the laws of the State of Colorado, USA, without regard to its conflict-of-law rules. Any dispute about Cetchup or these terms will be handled in the state or federal courts located in Colorado, unless the law where you live says otherwise.

13. Changes to these terms

When we change these terms, we'll post the new version here with a new version number and date. If a change is significant, we'll tell you in the app or by email before it applies. If you keep using Cetchup after a change applies, you're agreeing to the new terms.

14. The rest

• If part of these terms can't be enforced, the rest still applies.
• If we don't enforce part of these terms right away, we haven't given up the right to.
• These terms and the Privacy Policy are the whole agreement between you and us about Cetchup.
• These terms are between you and VibeTemp LLC, not Apple. Apple isn't responsible for Cetchup or its support.
